Website Policy

The following Terms and Conditions govern and apply to your use of or reliance upon this website maintained by Calgary Opera (the “Website”).

Your access or use of the Website indicates that you have read, understand and agree to be bound by these Terms and Conditions and any other applicable laws, statutes and/or regulations. We may change these Terms and Conditions at any time without notice, effective upon its posting to the Website. Your continued use of the Website will be considered your acceptance to the revised Terms and Conditions. You should visit this page periodically to review the then current Terms and Conditions of use.

Use of Website

You agree to use the Website for lawful purposes only and in a manner consistent with all applicable laws, rules and regulations. Potential users in any jurisdiction where laws (whether common or statutory) would: (i) void these Terms and Conditions of use in whole or in any essential part (the essential parts being at least, but not only, the provisions relating to the governing law and the disclaimer and limitation of liability); or (ii) render accessing or using the website illegal, are not authorized to use the Website.

Any material downloaded or otherwise obtained through the use of the Website is done at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

Intellectual Property

All intellectual property on the Website is owned by us or our licensors, which includes material protected by copyright, trademark, or patent laws. All trademarks, service marks and trade names are owned, registered and/or licensed by us. All content on the Website, including but not limited to text, software, code, designs, graphics, photos, sounds, music, videos, applications, interactive features and all other content is a collective work under Canadian and other copyright laws and is the proprietary property of Calgary Opera; all rights reserved.

Disclaimer

The Website and the content are provided “as is” without warranty of any kind. While we endeavour to provide information that is correct, accurate and timely, we disclaim all warranties, representations and conditions of any kind with respect to the Website and the content whether express, implied or collateral or whether arising by statute, course of dealing, custom or usage of trade, including, without limitation: (i) The content contained in or made available through the Website will be of merchantable quality and fit for a particular purpose, (ii) The Website or the content will be accurate, complete, current, reliable, or timely, (iii) That the operation of the website will be uninterrupted or error-free, (iv) That defects or errors in the website or the content (be they human or computer errors) will be corrected, (v) That the Website will be free from viruses or harmful components, (vi) That communications to or from the Website will be secure and/or not intercepted, and (vii) Any and all warranties, obligations, and conditions arising otherwise. Indemnification

You agree that your use of the Website and/or the content shall not be made the basis for any claim, suit, demand or cause of action or other proceeding against Calgary Opera, their respective affiliates or licensors. You agree, at your own expense, to indemnify, defend and hold Calgary Opera, their respective affiliates, licensors and their respective directors, officers, employees, representatives, and agents harmless against any claim, suit, demand, action or other proceeding brought or threatened by a third party as a result of (i) your breach of these Terms and Conditions of Use; and/or (ii) your use of the Website and/or the content.

The Website may include links to other internet sites maintained by third parties ("Linked Sites"). We provide access to Linked Sites solely as a convenience to you. We have no control over Linked Sites and you acknowledge and agree that we are not responsible for the availability of Linked Sites and you agree and understand that inclusion of Linked Sites does not imply endorsement by Calgary Opera of the Linked Sites or any content, advertising, products or other material available from Linked Sites. We shall not be held responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any Linked Sites, and we do not make any representation or warranty of any kind regarding any Linked Site including, without limitation, (i) any representation or warranty regarding the legality, accuracy, reliability, completeness, timeliness or suitability of any content on such third-party web sites, (ii) any representation or warranty regarding the merchantability and fitness for a particular purpose of any material, content, software, goods, or services located at or made available through such third-party web sites, or (iii) any representation or warranty that the operation of such third-party web sites will be uninterrupted or error free, that defects or errors in such third-party web sites will be corrected, or that such third-party web sites will be free from viruses or other harmful components. While Calgary Opera generally accepts links to the Website, we reserve the right to prohibit or refuse to accept any link to the Website and, upon our request, you agree to remove any link you may have to the Website.

User Information

With the exception of requests for proposals and any personal information submitted through the Website, unless otherwise agreed to in writing between you and Calgary Opera, any information or materials which you may provide to us (whether electronically or through your access to or usage of the website) including feedback data, such as questions, comments, suggestions or the like regarding any information contained on the Website, shall be deemed to be non-confidential and we shall have no obligation of any kind with respect to such information and/or materials. You hereby grant Calgary Opera a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to (i) use, reproduce, store, adapt, translate, modify, make derivative works from, transmit, distribute, publicly perform or display such information and materials for any purpose and/or incorporate such information and materials in any form, media or technology now known or developed in the future, and (ii) to sublicense to third parties the unrestricted right to exercise any of the foregoing rights. In addition to the grant of the above license, you hereby (i) agree to waive all moral rights in such information and materials in favour of Calgary Opera and (ii) acknowledge and agree that Calgary Opera is not responsible for any loss, damage or corruption that may occur to such information or materials.

General Terms

These Terms and Conditions of use constitute the entire agreement between you and Calgary Opera with respect to the subject matter hereof. These Terms and Conditions shall inure to the benefit of, and be binding upon you and Calgary Opera and each of our respective successors and assigns. The invalidity or unenforceability of any provision of these Terms and Conditions or any covenant contained herein shall not affect the validity or enforceability of any other provision or covenant contained herein and any such invalid provision or covenant shall be deemed severable from the rest of these Terms and Conditions. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Governing Law & Jurisdiction

By accessing or using the Website, you agree that all matters relating to your access to, or use of the Website and the its content shall be governed by the laws of the Province of Alberta and the laws of Canada, without regard to conflict of laws principles. You agree and hereby submit to the exclusive jurisdiction of the Federal Court of Canada and/or the courts of the Province of Alberta with respect to all matters relating to the Website.

Privacy Policy

The terms of the Calgary Opera privacy policy are incorporated herein. You consent to the use of your personal information by Calgary Opera and/or their third party providers and distributors in accordance with the terms and for the purposes set forth in such privacy policy.

Ticket Policy

Your Order

All individual tickets include a 3.5% service fee. Our current ticket booking policy states that Season Subscription holders may, at no charge, cancel their tickets at any time up to 48 hours before the performance and have the option to exchange tickets to another performance, or donate the amount of the tickets back to Calgary Opera.

Single Ticket holders may, for a fee, exchange their tickets up to 48 hours before the performance for another performance within the season, or opt to donate the face value of their ticket and receive a tax receipt for amounts over $20. No refunds will be provided.

Payment is processed immediately on receipt of order. It is the responsibility of the ticket holder to check their ticket for the correct performance, day of the week and curtain time. Program and artists are subject to change without notice.

Ticket prices for in-person productions are inclusive of GST and CRF (capital replacement fund for the Jubilee Auditorium) fees. All orders are subject to handling fees, regardless of whether tickets are printed or emailed.

We reserve the right to change prices without prior notice. All ticket sales and exchanges will be processed at the published prices at the time of the order or exchange.

Tickets obtained from unauthorized sources may be invalid, lost, stolen or counterfeit and may not be honoured. Management reserves the right to refuse entry on re-sold tickets without refund.

Account information is confidential and any updates or changes must come from the account holder. Ticket exchanges, releases and reprints can only be made by those named on the account. Weather Policy

Calgary Opera is committed to honouring its published performance schedule. All performances will proceed as scheduled regardless of weather conditions.

Please allow for plenty of extra time when travelling to the theatre in inclement weather. Please note that Calgary Opera is not responsible for parking lot conditions or snow removal at the Southern Alberta Jubilee Auditorium.

We regret that tickets not used due to inclement weather cannot be refunded. If you suspect the weather will impact your ability to attend, Calgary Opera tickets may be exchanged for another performance of the same opera (subject to availability and exchange charges), or donated back to Calgary Opera up to and no later than 48 hours before the original ticketed performance date.

Exchanges

All tickets are exchangeable for another performance of the same opera (subject to availability and exchange charges) up to and no later than 48 hours prior to the original ticketed performance date. Tickets may be exchanged through Calgary Opera Audience Services by phone at 403-262-7286 or email info@calgaryopera.com. There is no cost for Subscriber exchanges and individual ticket exchanges are subject to a per-ticket service charge.

If a patron requests to be re-seated for any reason after their ticket has been scanned at the venue, seat choice is at the discretion of Jubilee or Calgary Opera staff, and no full or partial refunds will be issued.

We reserve the right to change prices without prior notice. All ticket sales and exchanges will be processed at the published prices at the time of the order or exchange.

Unable to Use Your Subscription Tickets?

If you are unable to exchange or transfer your subscription tickets, as a charitable organization Calgary Opera can issue the purchaser a tax receipt for the face value of the tickets. Ticket returns in exchange for a tax receipt must be completed no later than 48 hours prior to your scheduled performance—past performance tickets cannot be returned for a tax receipt. Ticket returns cannot be used towards member programs.

Lost Tickets

For subscribers, lost tickets can be replaced free of charge by contacting Calgary Opera Audience Services at 403-262-7286 or visiting the customer service table at the venue on the night of the performance. Non-subscription tickets that have been lost or misplaced may incur a reprint fee per ticket reprinted. If you forget your tickets on the day of the performance, please contact our staff at the venue Box Office on site.

Print at home tickets will be sent at the time of purchase by sales@calgaryopera.com with the subject line "TICKETS - Calgary Opera".

Accessibility and Wheelchair Seating

Please note the following services are for performances at the Jubilee Auditorium only. The Mamdani Opera Centre is, regrettably, not a barrier-free facility.

Limited wheelchair and companion seating is available. Please contact Calgary Opera Audience Services at 403-262-7286 to arrange for seating. Wheelchair seating must be arranged at the time of ticket purchase and wheel chair or limited mobility seating cannot be guaranteed on the day of the performance without prior arrangement. The Jubilee Auditorium is fully wheelchair accessible (with the exception of the second balcony) with ramps available at the north entrance. Accessible parking is available in the North Lot only.

Assisted listening devices are available at the coat check on the main level.

Certified service dogs are welcome in the Jubilee Auditorium and the Mamdani Opera Centre.

 Cameras & Recording Devices

The use of cameras, video cameras or sound-recording devices of any kind is prohibited during performances. Any person using an unauthorized recording device will be required to surrender or erase any recordings, photographic or digital images and may be asked to leave. No refunds will be issued in this case.

Electronic Devices

The use of mobile and smartphones, smart watches, and all other electronic devices is extremely disruptive and is strictly prohibited during performances. Any patron who may need to be contacted for emergency purposes during a performance should speak with the Box Office for assistance before the performance begins.

Children & Babies

All patrons, including children, must have a ticket for the performance. Children 15 years of age or under must be accompanied by and seated next to an adult. Children should be able to sit quietly throughout the performance. If unable to do so, children and their accompanying adult will be asked to leave the auditorium. Babes-in-arms will not be admitted into the auditorium.

Parental Advisory

Children of varying ages attend most Calgary Opera productions, but be advised that the majority of operas contain adult subject matter and themes, such as death and violence, alcohol consumption, nudity and sexual situations, that some parents may consider inappropriate for children. Calgary Opera believes that each individual parent is best placed to judge whether a particular opera or staging of that opera is appropriate for, and of sustainable interest to, the maturity level of their child. Tickets are non-refundable. If you have any concerns or questions about the subject matter, specific staging or general suitability of a particular performance, please contact Calgary Opera Audience Services at 403-262-7286 before purchasing tickets.

Etiquette

Patrons are reminded that the Jubilee Auditorium is an extremely lively theatre space and that all audience noise will be accentuated and audible to other patrons. Turn off all electronic devices (including smartwatches), avoid talking, humming, moving loose seats, kicking the backs of seats, rustling programs, and unwrapping candies or cough drops. For the safety of all patrons, please remain in your seat until the performance has completely ended and the house lights have been turned on.

As a courtesy to fellow patrons, lease refrain from wearing strong scents such as purfume or cologne.

Latecomers

In the interest of safety and for the comfort of all patrons and performers, latecomers may not enter the auditorium or be seated unless there is a suitable break in the performance. Latecomers may be directed toward reserved “latecomer seating”, and may take their ticketed seats at intermission, and no full or partial refunds or credits will be issued. Patrons leaving the auditorium during the performance or returning late after intermission may not be readmitted or may be accommodated in an alternate viewing location. Latecomers are invited to view the performance from monitors in the lobby area.

To ensure a full and enjoyable evening at the opera, please check your tickets for performance start times and plan to arrive early.

Coat & Parcel Check

To uphold the safety of the building, oversized bags and parcels may be prohibited from entering the auditorium. At the Jubilee Auditorium, the coat check is located in the Main Floor Lobby.

Venue Policies

Outside food and beverages are prohibited from entering the venue. Patrons consent to appear in recorded material by attending performances/events. Management reserves the right to refuse admission without refund if conditions are violated, and expel from the premises any person whose presence or conduct is deemed objectionable.

Smoking, Vaping & Cannabis

The Southern Alberta Jubilee Auditorium and Mamdani Opera Centre are smoke-free and vape-free facilities.

Calgary Opera Personal Information Protection Policy

Calgary Opera is committed to safeguarding the personal information entrusted to us by our patrons. We manage your personal information in accordance with Alberta’s Personal Information Protection Act and other applicable laws. This policy outlines the principles and practices we follow in protecting your personal information.

This policy applies to Calgary Opera and any person providing services on our behalf. A copy of this policy is provided to any patron upon request.

What is Personal Information?

Personal information means information about an identifiable individual. This includes an individual’s name, home address, phone number, email address, age, sex, marital or family status, an identifying number, financial information, educational history, etc.

What Personal Information Do We Collect?

We collect only the personal information that we need for the purposes of providing services to our patrons. This information may include your name, contact information, ticketing and donor history, seating preferences, credit card information, and patron communications such as letters or verbal feedback.

We normally collect this information when you purchase tickets or provide us with financial or volunteer support. It may come to us through your phone call, email, fax, or mail order, or when you visit Calgary Opera Audience Services.

Consent

We inform our patrons, before or at the time of collecting personal information, of the purposes for which we are collecting the information. The only time we don’t provide this notification is when a client volunteers information for an obvious purpose (for example, producing a credit card for renewing or adding to a current subscription account held with us).

A patron may withdraw consent to the use and disclosure of personal information at any time, unless the personal information is necessary for us to fulfill our legal obligations. We will respect your decision, but we may not be able to provide you with certain products and services if we do not have the necessary personal information.

How Do We Use and Disclose Personal Information?

Calgary Opera uses personal information for billing purposes, to mail tickets and tax receipts, and to contact patrons about current & upcoming opera programming, special events, and special offers. Personal information may also be used for phone calls to sell subscriptions, tickets and solicit donations.

We make every effort to co-ordinate points of contact so that our patrons do not receive more than a reasonable number of letters or phone calls. If you do not wish to receive updates and information from Calgary Opera, you may call us at 403-262-7286, or write to us at: Calgary Opera, 1315 – 7 Street SW, Calgary, AB, T2R 1A5. When you contact us, please let us know if you do not wish to receive mail, phone calls, or emails.

Calgary Opera never rents, sells or trades the personal information of subscribers, donors, sponsors or volunteers with any organization. If we share your information with an outside organization (such as a mailing house sending out postcards) we have a contract binding them to the same strict privacy controls that we use ourselves.

If we wish to use or disclose your personal information for any new business purpose, we will first ask for your consent.

How Do We Safeguard Personal Information?

Personal information is stored in a cloud-based database on servers housed in the continental USA and, on rare occasion, in hard copy files. Information in electronic format is password-protected in secure data files. Information in hard copy format is stored in a locked or restricted area at all times. Only authorized Calgary Opera personnel have access to this information.

Personal information is retained only as long as is reasonable to fulfill the purposes for which the information was collected or for legal or business purposes. We destroy paper files containing personal information by shredding. We destroy electronic information by deleting it, and, when the hardware is discarded, we ensure that the hard drive is physically destroyed.

Calgary Opera values our patrons and their right to privacy, and are committed to ensuring that we are in strict adherence with Canada’s Anti-Spam Legislation in all of our digital communications.

We make every reasonable effort to ensure that patron information is accurate and complete. We rely on our patrons to notify us if there is a change to their personal information that may affect their relationship with our organization. If you are aware of an error in our information about you, please let us know and we will correct it on request wherever possible. In some cases (such as a change of name for a subscription account) we may ask for a written request for correction.

Access to Records Containing Personal Information

Patrons of Calgary Opera have a right of access to their own personal information in a record that is in our custody or under our control, subject to some exceptions. For example, organizations are required under the Personal Information Protection Act to refuse to provide access to information that would reveal personal information about another individual.
